We have many examples of successful stories where our counseling helped our clients achieve their goals:
- We advised a large US firm in connection with several legal aspects concerning the manufacturing process of its products, paving the way for their commercialization as novel food ingredients in the EU.
- We advised a US multinational in its strategy of introducing several of its products in the Spanish market for professional use in restaurants and food manufacturers.
- We advised a US pesticides producer on legal requirements arising from the marketing in one Member State of foods with residues of one of their products.
- We advised a French multinational company in its strategy of commercialization of their food supplements, botanical extracts and cosmetics products range in Spain. We helped design the commercial strategy, revised the composition, presentation and labeling of the whole range of products and successfully adapted them to comply with Spanish law.
- We advised several US firms in their strategy to introduce nutraceutical products in Spain. We successfully registered their products in another Member State (Belgium) with a more favorable regime towards them than that adopted by the Spanish authorities and legally placed them in the Spanish market by virtue of the principle of mutual recognition.
- We negotiated a world-wide brand licensing agreement on behalf of a French innovative foods company with one of the most relevant health product personalities in Europe.
- We filed several complaints before the European Commission on behalf of a national association of food supplement manufacturers in the face of continued refusals to register botanical extracts as food supplements and other restrictive administrative measures. As a result thereof, the EC brought Spain before the European Court of Justice and addressed comfort letters to the companies involved stating Spain’s failure to comply with EU law and their right to obtain redress.
- We advised a US investment bank in its strategy of entering the biscuits and confectionary market in the face of increasing pressure from anti-obesity and healthier eating trends.
- We advised a US enzyme producer on compliance of their products with several EU jurisdictions, paving the way for their commercialization in the EU.
- We advised a food supplements manufacturers and distributors association in proceedings against a Member State before the European Commission for incorrect implementation of an EU directive.
- We registered a wide array of products manufactured by several Spanish, French, German and US companies in Belgium (around 100 products registered), a Member State with a more favorable legal regime towards these products, thus reinforcing their position in the Spanish and other EU markets by virtue of Article 28 EC.
